Citation Watch: Minnesota Co-op Fined $120,000 for Violation of the Risk Management Program

A Minnesota co-op located in Randolph and Montgomery Minnesota. This Minnesota co-op stores anhydrous ammonia in excess of 10,000 lbs.

This co-op did not follow the mandates outlined in the risk management plan program. They were cited at both locations for:

• The Randolph Facility failed to document names or positions of people responsible for the implementation of the facility’s RMP Program elements and to document the lines of authority between them, as required by 40 C.F.R. § 68.15(c).
• The Randolph Facility failed to maintain records of the off-site consequence analysis, as required by 40 C.F.R. § 68.39.

The facility was fined $120,000 for both facilities being out of compliance. The facilities will need to file an updated RMP to the EPA, documenting names or positions of people responsible for the implementation of the facility’s RMP program elements and to document the lines of authority between them, as required by 40 C.F.R. § 68.15(c). and they will need to maintain records of the off-site consequence analysis, as required by 40 C.F.R. § 68.39. This will be captured in their revised RMP.
